Rules for using materials of TASS digital resources

1. DEFINITIONS

TASS is the ITAR-TASS News Agency (OGRN (Primary State Registration Number) 1037700049606; address: block 1, 10, Tverskoy blvd., Moscow, 125009, Russian Federation.).

TERMS are these RULES FOR USING MATERIALS OF THE TASS DIGITAL RESOURCES determining the terms and conditions of the Use of the Materials published on the TASS Digital Resources.

Digital Resources are TASS websites: tass.com including their versions for mobile and other multimedia devices (hereinafter referred to as the Websites) and TASS applications for mobile and other multimedia devices: «ТАСС сейчас»; «ТАСС Календарь»; «ТАССНИМКИ» (hereinafter referred to as the Applications).

Materials are any information, messages, data published on the TASS Digital Resources both collectively and individually regardless of their presentation form and attribution to the results of intellectual activities including (but not limited to): Text Materials, photographic works, audiovisual works, musical works (with or without text), paintings, graphic works, design works (including illustrations and design features of a TASS Digital Resource) and other copyrighted/exclusive materials except the objects that the other persons are specified as right holders/authors and (or) borrowing sources of which.

Text Materials are news information (headlines, articles, quotes, comments as well as messages transmitted in the RSS 2.0 format) which is displayed in text form, distributed on the TASS Digital Resources and of informational nature only (information about current news of the day, events and facts).

Use is any display, distribution, dissemination to the general public, broadcasting, transmission by cable, import, rental, public performance, translation and other revision of the Materials of the TASS Digital Resource as well as other uses stipulated by applicable laws as at the moment of such use regardless of whether the relevant actions are taken for the purposes of profitmaking or without such purpose, whether the Materials are used in full or in part.

User is any person visiting the TASS Digital Resource and/or Using its Materials including (but not limited to): mass media and information agencies, subscribers to the TASS information products and services, other citizens (individuals) and organizations (legal entities) which are not mass media.

 

2. GENERAL PROVISIONS

2.1. These Rules are developed according to the applicable laws of the Russian Federation including the Constitution of the Russian Federation, the Civil Code of the Russian Federation, the Law of the Russian Federation No. 2124-1 «On Mass Media»  dated 27.12.1991 and the Federal Law No. 149-ФЗ «On Information, Information Technologies and Protection of Information» dated 27.07.2006.

2.2. Except the cases of acceptable Use of the Text Materials stipulated by applicable laws of the Russian Federation and these Terms, the Use of other Materials of the TASS Digital Resources without prior written permission of TASS is strictly prohibited.

2.3. These Terms apply to all Users. A User shall be deemed to have accepted the provisions of these Terms in full, without any reservations, remarks and exceptions at the time of the first visit of the TASS Digital Resource and/or Use of its Materials. The User shall stop visiting a TASS Digital Resource and/or Using its Materials if he/she disagrees with any provision of these Terms.

2.4. These Terms do not constitute an agreement and may be amended by TASS unilaterally without notifying the Users. The amendments shall become effective from the date of publication of the revised version of the Terms. The current version of the Terms is available at https://tass.com/terms-of-use. Users undertake to check regularly the provisions of these Terms for any amendments and/or additions. A User shall be deemed to have read and accepted the amendments to the Terms if he/she is visiting a TASS Digital Resource and has continued any Use of the Materials of the TASS Digital Resources after publication of the revised version of the Terms.

2.5. The right holder of the Materials published on the TASS Digital Resources is TASS (unless otherwise specified) or such Materials shall be used by TASS by virtue of an agreement or on other legal grounds according to the right stipulated by applicable laws.

2.6. No provision of these Terms shall grant the right to use the corporate name, domain names, trademarks of TASS or intellectual property items of third parties to the Users with the exception of cases when TASS is mentioned as the source of information expressly stipulated by these Terms.

 

3. CONDITIONS OF USING THE MATERIALS

3.1. The Materials of the TASS Digital Resources may be Used only under the terms of an agreement concluded with TASS. Any Use of the Materials prior to conclusion of the a separate agreement, except the cases of acceptable Use of the Text Materials under the conditions determined by these Terms, shall be deemed to be violation of the Terms and is unlawful Use.

3.2. Free of charge Use of the Materials is prohibited except the cases of acceptable Use of the Text Materials determined by the Terms.

3.3. According to the conditions of these Terms and as part of the functionality of the TASS Digital Resources, only Non-Commercial Use of the Text Materials in cases specified in Clause 3.4 of the Terms is allowed.

3.3.1. Non-commercial use of the Text Materials shall be the Use of the Text Materials for the purposes not associated with making of profit from their sales or their inclusion into the product being sold as well as providing access to the Text Materials or the product containing them for a fee and on the websites/mobile applications and/or other devices on which the Text Materials are distributed and/or otherwise displayed which are monetized at the expense of display of advertising.​

3.5. If the conditions in Section 4 of these Terms are fulfilled, Users may have Non-Commercial Use of the Text Materials free of charge in the following cases:

(A) On personal pages of individuals on the Internet, for the personal, informational, scientific, cultural, educational purposes without generating profit including by using «embed code» (embedding) provided by functionality of the Digital Resource containing an active Hyperlink to the page of the Text Material on the TASS Digital Resource by placing it in certain social media.

(B) On free information and educational digital resources/portals on the Internet, the websites of media/news agencies on the Internet.

(C) On the websites of charity organizations and educational institutions of all types – after receiving prior written consent of TASS.

(D) In materials of individuals and legal entities mentioned in the used Text Materials published on the TASS Digital Resources – without written consent of TASS.

3.5. The use of the Text Materials in the cases specified in Clause 3.4 of these Terms is allowed in the amount not exceeding 30% of the amount of the quoted Text Materials.

 

4. RESTRICTIONS AND TERMS OF USE OF THE MATERIALS

4.1. When Using the Materials for a fee, the possibility of their revision by the User shall be agreed during conclusion of a contract with TASS.

4.2. When Using the Materials free of charge, their revision by the User is prohibited.

4.3. In each case of Using the Text Materials of the TASS Digital Resources for any purposes, Users shall include a link (credit) to TASS as the source of information as follows:

4.3.1. When Using the Text Materials in printed media or in other forms distributed on tangible media, - at the place of use as a text reference (credit): ‘Source: TASS’ or ‘Source: TASS News Agency’.

4.3.2. When Using the Text Materials during the broadcast of radio, television, video or newsreel programs – as an oral reference (credit): ‘TASS’ or ‘TASS News Agency’.

4.3.3. When Using the Text Materials on the Internet or in any other forms of electronic use – by including the reference (credit) to TASS as the borrowing source into the material as an active indexed by search engines hyperlink (hereinafter referred to as the Hyperlink) to the page where the Text Material is published on the TASS Website or, in the event of additional agreement with TASS, to the main page of the Website where the Text Material is published.

4.3.4. The reference (credit) to the source or the Hyperlink must be located at the beginning of the reproduced Text Material. The font sizes of the reference (credit) or the Hyperlink should not be less than the font size of the text where the Text Materials are used. The hyperlink must meet the following conditions: (a) is contained in the source code of the page on which the quoted Text material is used; (b) is enclosed in the <a> tag and spelled out in the «href» attribute; (c) does not contain in the "rel” attribute the <a> tag of the "nofollow" and "noindex" parameters.

4.3.5. The use of the Text Materials obtained from secondary sources, in which messages there is a reference (credit) to TASS as the source of information, is possible only in the event of inclusion of the reference (credit) to the primary source in the manner determined by these Terms. In addition, to ensure compliance with the provisions of Clause 4.4 of the Terms, a User shall check the original Text Information published on the TASS Digital Resources.

4.4. A User undertakes to maintain accuracy and reliability when reproducing the Text Materials. The User shall be liable for inaccurate and unreliable reproduction of the Text Materials.

4.5. It is prohibited to Use the Text Materials or their fragments in the cases and by means other than those specified in Clause 3.4 of these Terms including by their inclusion into sms or email newsletters, RSS feeds, creation of interactive databases and in cases of their direct commercial Use including for the purposes of non-gratuitous exercise of the rights of access to them or other means of transfer of the rights to Use them to third parties without the written consent of TASS or concluding the relevant agreement with TASS.

4.6. In any cases, it is strictly prohibited to Use the Text Materials of TASS:

4.6.1. In media, on digital resources and websites containing information dissemination of which is prohibited in the Russian Federation.

4.6.2. If in this Use, the publication time is specified as identical or earlier than the time of publication of the relevant Text Materials on the TASS Digital Resources.

4.6.3. For the purposes damaging the reputation of TASS and/or third parties or causing any other damage to the specified persons/entities.

4.6.4. If this Use triggers association with the TASS brand or the existence of relations with TASS or approval of this use by TASS as well as approval of a User’s views and/or content for other Users.

4.6.5. In other cases if this Use causes or may cause harm to the TASS interests protected by law.

 

5. CONDITIONS OF USING OF TASS DIGITAL RESOURCES

5.1. The functionality and services of the TASS Digital Resources are provided «as is». TASS shall not be liable for expectations and conformity of the functionality and services of the TASS Digital Resources with the User’s goals. TASS may change and update the functionality and services of the TASS Digital Resources, carry out works on updating the design, engine and/or structure of the TASS Digital Resources without notifying the User in advance. TASS shall reserve the right to make changes, additions to any Material from the TASS Digital Resources, delete it and/or restrict access to it by unilateral decision.

5.2. Beginning to use the TASS Digital Resources, a User agrees to receive third-party advertising and information materials (hereinafter referred to as the advertising) including those integrated into the structure of the TASS Digital Resources. Placement of the advertising on the TASS Digital Resources shall not imply approval and/or recommendation of TASS to the advertised object and/or the advertiser. TASS does not determine and influence the contents of the advertising, is not responsible for third-party advertising including information about websites and links specified in the advertising which a User can follow by clicking the relevant advertising.

5.3. When using the TASS Digital Resources, a User shall act in good faith and not to do any things that can cause harm to the TASS Digital Resources and/or other third parties, including but not limited to:

5.3.1. Not use the TASS Digital Resources by means of any malicious software.

5.3.2. Not use any devices, computer programs and/or processes/scripts for interfering or attempting to interfere with the normal operation of the.

5.3.3. Not use any automatic and other computer programs which make it possible to obtain unauthorized access to any part, functionality and/or Materials of the TASS Digital Resources as well as to extract, copy, distribute and do other things with the Materials of the TASS Digital Resources.

5.4. For the purposes of preventing violation of these Terms including DDoS attacks, other hacker attacks, TASS may restrict the User’s access to the TASS Digital Resources.

 

6. RESPONSIBILITY FOR UNLAWFUL USE OF THE MATERIALS

6.1. The Use of the TASS Materials with violation of any provision of these Terms means that they are used without permission of TASS which is violation of the rights of TASS and/or third parties and entails criminal, civil and other liability stipulated by applicable law.

6.2. In addition, the User shall compensate TASS for all losses incurred as a result of claims of third parties which rights were violated due to the User’s unlawful actions against the User and receipt of orders, warnings and other acts of authorized government authorities, involvement of the Right Holder into judicial proceedings as a result of the User’s unlawful actions.

 

7. OTHER PROVISIONS

7.1. If for some reason, one or several provisions of these Terms are deemed to be invalid or unenforceable, it shall not affect the validity or enforceability of the remaining provisions.
