Yaroshenko waives right to appeal his verdict in US Court of Appeals
The ruling issued by the Court of Appeal for the Second Circuit in New York in late April rejected all the arguments of Yaroshenko’s defense offered in the appeals petition in June 2015
NEW YORK, May 6. /TASS/. Russian pilot Konstantin Yaroshenko serving a prison sentence in the U.S. has waived the right to appeal the verdict of the U.S. Court of Appeals for the Second Circuit in New York that earlier decided not to review his case, the Russian citizen’s lawyer Alexei Tarasov told TASS on Thursday.
"Konstantin Yaroshenko decided not to file a request to review his case in the court of appeals," he said. According to the lawyer, the deadline expired on Wednesday.
However, he was unable to confirm media reports that Yaroshenko is not going to apply to the U.S. Supreme Court. "We will discuss this, there are more than two months left (to appeal to the Supreme Court)," the lawyer said.
Tarasov also noted that the Russian national had not waived his services. "I have no official notification saying that Yaroshenko waives all legal defense, specifically my services," he said.
The ruling issued by the Court of Appeal for the Second Circuit in New York in late April rejected all the arguments of Yaroshenko’s defense offered in the appeals petition in June 2015. Tarasov earlier said there is a possibility to apply for reviewing this case by the same court of appeal.
Yaroshenko was sentenced to 20 years in prison on September 7, 2011. He was brought to the U.S. from Liberia where he was arrested on May 28, 2010. Undercover agents of the U.S. Drug Enforcement Administration allegedly caught him in a criminal intent to transport a large consignment of cocaine. The Russian citizen is serving his prison sentence in Fort Dix prison, New Jersey.
