Armenian court of appeals grants sanction to arrest former president Kocharyan

The court has upheld the ruling of the first-instance court on the arrest, the lawyer said

YEREVAN, December 7. /TASS/. The Armenian Court of Appeals granted a sanction on Friday to arrest former Armenian President Robert Kocharyan, who is charged with overthrowing the constitutional order in 2008, a lawyer for the former president, Aik Alumyan, told journalists.

"The court of appeals has upheld the ruling of the first-instance court on Kocharyan’s arrest," Alumyan reported.

According to another lawyer for Kocharyan, Ruben Saakyan, Kocharyan himself was not present in the courtroom. "Kocharyan was not present when the verdict was announced, but I don’t think that he will escape responsibility. I don’t know when the verdict will come into force, probably today," the lawyer said, promising to report details of the court’s ruling and their position at the upcoming press conference.

On July 26, the Special Investigative Service of Armenia charged Kocharyan with the violent overthrow of the constitutional order in 2008 and asked the court to choose arrest as a pre-trial restriction for him. Later in the day Kocharyan was interrogated by investigators under the criminal case on murders and protest rallies of the opposition on March 1, 2008. On July 27, the former president was placed into custody. On August 13, the Yerevan Court of Appeals decided to release Kocharyan due to the fact that he has immunity under the constitution. On November 15, the Armenian Court of Cassation partially satisfied the Prosecutor General’s motion and sent Kocharyan’s case to the Court of Appeals for revisiting.
