The agreement, signed in Hanoi on November 12, 2013, stipulates that a person sentenced to imprisonment in the territory of either side may be transferred to the other for serving his sentence. The agreement also contains requirements to the contents of the requests on the transfer of convicts and response to them and determines the conditions for the transfer of convicts, one of them being convicts’ written consent to the transfer to the other state.
The agreement also contains rules that are not stipulated by Russian legislation. For instance, the transfer request will not be granted if a convict fails to fulfil some financial commitments following from his sentence or if the guarantees for the fulfilment of these commitments are insufficient, in the view of the state.
The basic rights and freedoms of person and citizen are the agreement’s subject matter. In particular, its Article 10 secures citizens’ constitutional right not to be convicted twice for one and the same crime.
“The agreement will promote further friendly relations development between the Russian Federation and the Socialist Republic of Vietnam,” says an explanatory note to the agreement.
