Prosecutor finds lawful denial for release on parole to Lebedev

For the term of Lebedev’s imprisonment he was disciplined more than ten times and was not commended at all

ARKHANGELSK, April 28 (Itar-Tass) —— The prosecutor’s office in the Arkhangelsk Region has found lawful the denial for release on parole to the former MENATEP CEO Platon Lebedev, senior aide to the regional prosecutor Yulia Shevchenko told Itar-Tass on Saturday.

The prosecutor’s office tried an appeal of Lebedev’s lawyer to the ruling of the Velsky District Court and the Arkhangelsk Regional Court over the denial for release on parole to the convict.

“No law violations were found that could have entailed the cancellation of the Velsky District Court ruling to deny the release on parole to Lebedev and the verdict by the criminal legal penal of the Arkhangelsk Regional Court. The court verdicts against Lebedev are lawful. There are no reasons for a prosecutor’s resolution,” Shevchenko said.

She also noted that there are no reasons for a service inquiry against employees of the prosecutor’s office, who tried an appeal for Lebedev’s release on parole, and the prosecutors, who were participating in a meeting of the cassation penal, because no violations on their part were found.

On July 27, 2011, the Velsky District Court of the Arkhangelsk Region denied the release on parole for Lebedev. On September 16, 2011, the regional court upheld the lawfulness of this court verdict.

“For the term of Lebedev’s imprisonment he was disciplined more than ten times and was not commended at all. The dynamics of his behaviour does not point to his improvement,” the prosecutor said at the court sessions.

On December 30, 2010, the Khamovnichesky District Court of Moscow sentenced to 14 years in prison the former YUKOS CEO Mikhail Khodorkovsky and the former MENATEP CEO Platon Lebedev for the oil misappropriation and money laundering. The convicts and their lawyers appealed this verdict and the Moscow City Court commuted their sentence by one year on May 24, 2011. Thus, with due account of the court verdict passed in 2005 the term in prison for Khodorkovsky and Lebedev will expire in 2016.

The convicts filed appeals for release on parole back in Moscow, because they already served more than a half of their term in prison (including the term in prison under the first criminal case). The Preobrazhensky District Court did not try their appeals over the convoying of Lebedev and Khodorkovsky to the Arkhangelsk Region and Karelia, respectively.
