MOSCOW, February 14 (Itar-Tass) —— The Russian Investigative Committee disagrees with the court decision, which allowed to release sportsman Rasul Mirzayev on bail and intends to appeal to the prosecutor's office against the ruling, the committee's spokesman Vladimir Markin told Itar-Tass.
Student Ivan Agafonov died after the sportsman hit him. Mirzayev is a world mixed martial arts champion.
In August 2011, when Mirzayev was detained, it was the Investigative Committee that appealed to court to hold him in custody, explaining that his actions caused grave consequences.
Naturally, the Investigative Committee disagrees with the decision to release him from custody, Markin said. In this connection, the Investigative Committee intends to insist on holding Mirzayev in custody until a sentence is pronounced for him.
Earlier, sources at the Russian Prosecutor-General's Office said the Moscow Prosecutor's Office would appeal against the ruling of the Zamoskvoretsky court.
On Monday, Moscow's Zamoskvoretsky court ruled to release Mirzayev on bail, though the prosecutor's office and Agafonov’s parents asked to hold him in custody. Judge Olga Novichkova pronounced the decision to release him on a 100,000 roubles bail. She explained that when Mirzayev was placed under arrest in August last year, he was charged with a grave crime -- intentional infliction of bodily harm resulting in the death of the victim, for which the Russian Criminal Code prescribes up to 15 years of imprisonment. At present, another charge is brought against him -- causing death by negligence (up to two years of imprisonment).
