Court completes investigation in Spartak fan Yegor Sviridov murder case

At a court session on Wednesday the litigating parties completed to produce the evidence to the jury

MOSCOW, October 12 (Itar-Tass) —— The Moscow City Court has completed an investigation in the murder case of a Spartak fan Yegor Sviridov on Wednesday.

At a court session on Wednesday the litigating parties completed to produce the evidence to the jury. The litigating parties will have the hearings of arguments at a next court session on October 17.

Six people are in the dock. A Nalchik resident Aslan Cherkesov, 27, is charged with murder, an attempt at murder, a deliberate light bodily damage, robbery and hooliganism. Other defendants, namely Dagestan residents Akai Akayev, 20, Artur Arsibiyev, 20, and Nariman Ismailov, 20, as well as Ramazan Utarbiyev, 21, and Khasan Ibragimov, 19, are accused of hooliganism and the deliberate light bodily damage.

The detectives found out that overnight to December 6, 2010, the drunken defendants went up to a group of Muscovites, who were waiting for a taxi, at a bus stop on the Kronshtadtsky Boulevard. “Abusing a slight reason for the fight the accomplices attacked the young people and beat them up,” a source in the Prosecutor General’s Office said. Meanwhile, Cherkesov has made two shots from a traumatic pistol Streamer-2014 at two people, “inflicting a slight bodily damage to them,” and then has made two shots in Sviridov. The latter died of wounds. Then, the public prosecutor found that Cherkesov has made six more gunshots at another injured party, stole his bag, and the attackers escaped from the crime scene.

A instructor, who gave the basic arms handling course to Aslan Cherkesov that became the main defendant, was interrogated by one of the last witnesses in the court on Wednesday. The witness confirmed that Cherkesov was informed that Russian citizens can use the gun for the protection of their life, health and property, but “the most important thing that at first a warning should be made that can be some words, a whistle or a warning gunshot in the air or in the ground, and only after that a gunshot to stop can be made in the hands or legs (you cannot shoot without targeting or targeting in the head).” Meanwhile, the investigator noted the gun cannot be used at mass venues.

In an unexpected attack, when the level of danger cannot be estimated, one can use the gun, but is banned to target in the head, the witness said. It is permitted to shoot for effect only in case of an armed attack, Zurumov noted. “If a person used the gun, or, moreover, a person was killed or injured in the gunshot, the shooter should inform the police about this,” the witness underlined.

Aslan Cherkesov said in the Moscow City Court earlier that he had to use the gun in a brawl on the Kronshtadtsky Boulevard. “I did not have a chance to avert the attack on myself without using the gun,” he told the court, noting that he was frightened and was in the state of shock at that moment.

The detectives found out that on the day of Sviridov’s murder Cherkesov used the gun in another conflict on the Kronshtadtsky Boulevard.

The court without the jury interrogated a doctor at the detention center Larisa Alyoshina, who stated that “when the defendants were brought there no bodily damages were found on them,” but she does not remember the concrete defendants. Since the witness cannot say anything about real case files, the judge refused to the public prosecutor to interrogate Alyoshin by the jury.

Five of six defendants did not plead guilty. Cherkesov’s lawyer stated earlier that his client “does not deny the use of weapons on the Kronshtadtsky Boulevard,” but this was done for the self-defence, he remarked. Meanwhile, Cherkesov rejects the accusations in hooliganism and robbery.

After the Sviridov murder massive disorders broke out on the Manezh Square last December. The Tverskoy District Court of Moscow is trying the criminal case over massive disorders.

The Moscow City Court launched the trial behind closed doors over the murder of another Spartak fan Yuri Volkov in July 2010.
